Terms of Use

These Terms of Use apply to the websites, landing pages, mobile pages, forms, chat interfaces, WhatsApp integrations, lead forms, and related digital services operated by PERCENT &CO REAL ESTATE L.L.C. under the Percent&Co brand.

1. Acceptance of these Terms

These Terms of Use (the "Terms") govern access to and use of the websites, landing pages, mobile pages, microsites, forms, chat interfaces, WhatsApp integrations, lead forms, and any related digital services operated by PERCENT &CO REAL ESTATE L.L.C. under the Percent&Co brand (together, the "Site"). By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Site. If you are using the Site on behalf of a company or another person, you represent that you have authority to bind that entity or person to these Terms.

2. Purpose of the Site

The Site is provided for general informational, marketing, lead generation, and customer communication purposes in relation to real estate opportunities, brokerage services, property search tools, development marketing, and related services in the UAE and other jurisdictions where PERCENT &CO REAL ESTATE L.L.C. may lawfully operate.

The Site may include direct listings, off-plan opportunities, secondary market properties, area guides, calculators, market commentary, downloadable materials, and third-party or partner supplied property data.

3. Eligibility and lawful use

You may use the Site only if you can form a binding agreement under applicable law and only for lawful purposes. You agree not to use the Site in any way that violates any applicable law, regulation, permit condition, third-party right, or regulatory guidance relevant to real estate advertising, lead generation, privacy, anti-spam, intellectual property, or consumer protection.

You are responsible for ensuring that your use of the Site is lawful in the country from which you access it.

4. No brokerage, legal, tax, valuation, or investment advice

Content on the Site is provided for general information only. It does not constitute legal advice, tax advice, accounting advice, valuation advice, investment advice, mortgage advice, or a recommendation to buy, sell, lease, reserve, or invest in any property.

No brokerage, agency, fiduciary, advisory, or client relationship is created solely by browsing the Site, submitting a form, downloading materials, chatting with a bot, sending a WhatsApp message, or requesting a call back. Any such relationship arises only if separately agreed in writing under an executed engagement, reservation, brokerage, or other formal contract.

5. Property information, prices, availability, and marketing materials

Property descriptions, floor plans, images, renderings, amenities, maps, completion dates, expected returns, service charges, payment plans, financing examples, promotional offers, and availability are provided for convenience only and may change at any time without notice.

Measurements, layouts, photographs, CGI visuals, views, maps, and location markers are indicative only and may not reflect final or current conditions. Prices, inventory, reservation status, and developer incentives may change, expire, or be withdrawn without notice.

6. Real estate advertising compliance

Where required by applicable law or regulator guidance, property advertisements and promotional materials displayed through the Site may be subject to permit, approval, registration, disclosure, or QR code requirements. Nothing on the Site should be interpreted as a guarantee that a particular listing, project, campaign, or promotional statement remains approved, available, or valid at the time you view it.

Users should independently verify key property details, including the identity of the seller or developer, property title status, escrow or project registration (where relevant), permit details, and any legally required advertisement verification information.

7. Third-party content and aggregator functionality

The Site may function as an aggregator, comparison tool, directory, or discovery interface and may display content supplied by developers, owners, portals, data vendors, marketing partners, or other third parties. We do not control all third-party content and do not guarantee its completeness, accuracy, timeliness, legality, or fitness for your purposes.

We may remove, re-order, de-prioritise, or refuse to publish any listing, project, advertisement, user submission, or partner feed at our discretion.

8. Enquiries, lead forms, and communications

When you submit an enquiry, request a brochure, ask for a valuation, book a viewing, use chat, or contact us through WhatsApp, phone, e-mail, or a form, you confirm that the information you provide is accurate and that you are authorised to provide it.

You agree that we may contact you about your enquiry and related services using the contact details you provide, subject to applicable law and our Privacy Policy. Standard carrier, data, and messaging charges may apply.

9. User submissions

If you submit information, reviews, comments, suggestions, photographs, floor plans, documents, or other materials through the Site, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, publish, and use that content for the purpose of operating, securing, improving, and marketing the Site and our services.

You represent that you own or control the rights necessary for your submission and that the material does not infringe any third-party rights or violate any law.

10. Accounts and secure areas

If the Site offers user accounts, saved searches, dashboards, or secure portals, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us promptly of any unauthorised access or suspected security breach.

We may suspend or disable any account if we reasonably believe that your credentials have been compromised or that the account is being used in breach of these Terms.

11. Prohibited conduct

You must not: (a) scrape, crawl, harvest, copy, mirror, frame, or systematically extract Site content without our written consent; (b) use bots, scripts, or automated means to submit enquiries, test forms, overload systems, or access data; (c) upload malicious code; (d) interfere with Site security or availability; (e) impersonate any person; (f) submit misleading, false, defamatory, infringing, or unlawful material; (g) use the Site to spam, solicit, or generate leads for unrelated businesses; or (h) attempt to reverse engineer any software, ranking logic, lead routing, or data structure used on the Site.

12. Intellectual property

The Site, including its text, layout, branding, logos, design elements, software, databases, compilations, graphics, photos, videos, downloads, and other content, is owned by or licensed to PERCENT &CO REAL ESTATE L.L.C. and is protected by applicable intellectual property laws.

Except as expressly permitted in writing, you may not reproduce, distribute, modify, publish, display, create derivative works from, or exploit any part of the Site for commercial purposes.

13. Third-party links, tools, and platforms

The Site may contain links to third-party websites, CRMs, payment providers, map services, mortgage tools, calendars, chat platforms, social networks, portals, or external booking tools. We provide them for convenience only and do not endorse or assume responsibility for third-party content, policies, availability, or practices.

Your use of third-party sites and services is governed by their own terms and privacy notices.

14. Privacy and data handling

Our collection and use of personal data in connection with the Site are described in our Privacy Policy. By using the Site, you acknowledge that personal data may be processed for responding to enquiries, providing requested services, maintaining security, managing leads, analytics, quality control, and legal compliance.

You must not submit another person's personal data unless you are authorised to do so and have provided any notices or obtained any consents required by applicable law.

15. No warranties

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, PERCENT &CO REAL ESTATE L.L.C. disclaims all representations, warranties, and conditions, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, availability, uninterrupted access, and freedom from viruses or harmful components.

We do not warrant that the Site will always be available, secure, error-free, or compatible with your device or network, or that property data, pricing, maps, translations, or automated outputs will always be current or correct.

16. Limitation of liability

To the maximum extent permitted by law, PERCENT &CO REAL ESTATE L.L.C., its affiliates, shareholders, officers, employees, brokers, agents, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, opportunity, data, or anticipated savings arising out of or in connection with your use of or inability to use the Site.

Where liability cannot lawfully be excluded but may be limited, our aggregate liability arising out of or relating to the Site will not exceed the greater of: (a) AED 500; or (b) the amount you paid us, if any, specifically for access to the relevant digital service during the 3 months preceding the event giving rise to the claim.

17. Indemnity

You agree to indemnify, defend, and hold harmless PERCENT &CO REAL ESTATE L.L.C. and its affiliates, officers, employees, agents, contractors, and licensors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Site, your breach of these Terms, your submissions, or your violation of any law or third-party rights.

18. Suspension and termination

We may suspend, restrict, or terminate access to all or any part of the Site at any time, with or without notice, if we believe that you have breached these Terms, created risk for us or others, or where suspension is required for maintenance, security, compliance, or business reasons.

19. Changes to the Site and these Terms

We may update, modify, suspend, or discontinue any part of the Site at any time. We may also amend these Terms by posting the updated version on the Site. Unless stated otherwise, changes take effect when published. Your continued use of the Site after publication of revised Terms constitutes acceptance of the revised Terms.

20. Governing law and dispute resolution

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Site, except to the extent that mandatory law grants you non-waivable rights or requires a different forum.

Before initiating formal proceedings, you agree to attempt to resolve the matter by sending written notice to info@percentco.ae with reasonable details of the claim.
